Wild Rewards Loyalty Program Terms & Conditions

The Member Terms and Conditions set out in this document concern the operation of the Wild Cards & Gifts Rewards Loyalty Program, the use of the Wild Cards & Gifts Rewards Card, and any promotional activity and loyalty transactions that arise as a consequence of the Wild Cards & Gifts Rewards Loyalty Program.

Individuals who join the Wild Cards & Gifts Rewards Loyalty Program agree to be legally bound by these Member Terms and Conditions.

The Member Terms and Conditions may be modified at any time without prior notification by Wild Cards & Gifts in its absolute discretion. Any modification to the Member Terms and Conditions may be applied to a Member retrospectively.

Wild Cards & Gifts will not accept any liability for any Member Email that is misdirected, lost or not received.

Wild Cards & Gifts will not accept any liability for any Technical Issues that may cause damage to any computer related to or used in connection with the Wild Cards & Gifts Rewards Loyalty Program.

Wild Cards & Gifts may collect personal information from Members for the purpose of facilitating the Wild Cards & Gifts Rewards Loyalty Program. Personal information will be handled in accordance with Wild Cards & Gifts and its parent company WHSmith Privacy Policy- see our privacy policy here (https://WHSmith.com.au/privacy-policy/)

In its absolute discretion, Wild Cards & Gifts reserves the right to cancel, terminate, modify the Wild Cards & Gifts Rewards Loyalty Program or any aspect of it at any time and without notice.

Wild Cards & Gifts may, at any time and in its absolute discretion, require a Member to provide to Wild Cards & Gifts proof of identification (in a form requested by Wild Cards & Gifts) for Wild Cards & Gifts to verify the authenticity of their Wild Cards & Gifts Rewards membership and compliance with these Terms and Conditions. Failure to provide proof of identification may result in termination of a Member’s involvement in the Wild Cards & Gifts Rewards Loyalty Program. 

Wild Cards & Gifts will not be liable for any tax liability incurred by a Member in connection with the Wild Cards & Gifts Rewards Loyalty Program, including that incurred in the provision and/or utilisation of Rewards.

These Member Terms and Conditions are to be read in conjunction with any additional conditions associated with Rewards, including without limitation with the Website Terms and Conditions and other relevant Wild Cards & Gifts policies and or terms and conditions.

Wild Cards & Gifts decision in relation to all matters arising in relation to the Wild Cards & Gifts Rewards Loyalty Program is final and binding.

Any failure or delay by Wild Cards & Gifts in exercising its rights under these terms does not constitute a waiver of those rights. Any waiver by Wild Cards & Gifts must be in writing and signed by an authorised officer of Wild Cards & Gifts.

Nothing in these Member Terms & Conditions is intended to contravene any applicable law. To the extent that any provisions in these Member Terms and Conditions is invalid or unenforceable, it is to be read down so as to be valid and enforceable, and otherwise must be severed to the extent of any invalidity or unenforceability, without affecting the remaining provisions of these Member Terms & Conditions.

DEFINITIONS

“Anniversary” means the date 12 months from: A Member’s Join Date.

 “Join Date” means the date a Member joins the Wild Cards & Gifts Rewards Loyalty Program.

“Member” means individuals who sign up to the Wild Cards & Gifts Rewards Loyalty Program.

“Member Emails” means emails that are sent from Wild Cards & Gifts to a Member including emails about the individual’s membership, the Wild Cards & Gifts Rewards Loyalty Program, special offers, discounts, competitions and events.

“Member Profile” means the personal details of the Member.

“Member Terms and Conditions” means these terms and conditions as amended from time to time.

“Points” means the reward points earned by Members for Eligible Purchases in accordance with these Terms and Conditions;

“Points Balance” means a Member’s net cumulative Points (i.e. after all discounts, returns etc. have been applied) on Eligible Purchases whilst they are a Wild Cards & Gifts Rewards Loyalty member. Points earned from transactions made in store is added to a Member’s Points Balance on the day after the transactions is made and Points from transactions made online or through stores is added to the Member’s Points Balance on the day after the purchase is made.

“Wild Cards & Gifts” means Wild Cards & Gifts and its parent company WHSmith Australia Pty Ltd ABN No: 70146430622 and its authorised representatives.

“Wild Cards & Gifts Rewards Card” means the membership card issued by Wild Cards & Gifts to a Member or where no Membership card is issued, the Member Customer Number allocated to the Member.

“Wild Cards & Gifts Rewards Loyalty Program” means the loyalty program operated by Wild Cards & Gifts and its parent company WHSmith Australia providing Members with access to Rewards in accordance with these Member Terms and Conditions.

“Rewards” means Points, Vouchers or other benefits given to Members as a consequence of purchasing behaviours, incentives and/or promotions.

“Voucher” means the voucher which is issued to a Member as a result of accumulating Points in accordance with these Terms and Conditions. Vouchers are issued in AUD$5 denominations.

 “Technical Issues” means the technical malfunction of any telephone network, connection or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the internet or at any web site or intranet site.

 “Eligible Purchases” means all purchases except delivery costs and selected merchandise which Wild Cards & Gifts determines will not be eligible to earn Rewards and excluding any purchases made using gift cards, Vouchers or coupons. Any purchases which are returned will not constitute Eligible Purchases.

“Website” refers to the Wild Cards & Gifts website wildcardsandgifts.com.au where details of the Wild Cards & Gifts Rewards Loyalty Program (including the most up to date Terms and Conditions) can be found.

Wild Cards & Gifts Rewards MEMBERSHIP

Membership of the Wild Cards & Gifts Rewards Loyalty Program is open to individuals who are residents of Australia, and who are 18 years or older with a unique email address.

An individual becomes a Member as at the Join Date. Completion of the sign-up process to the Wild Cards & Gifts Rewards Loyalty Program is deemed acceptance of the Member Terms and Conditions.

An individual is deemed to be a Member when they sign up in store and or use their Wild Cards & Gifts Rewards Card during a transaction and/or earn or redeem Rewards Points.

When joining in-store, a sales consultant will record the individual’s first name, last name, email address and opt in/out to receive updates from Wild Cards & Gifts and its parent company WHSmith Australia at the register. Other details may be optionally recorded. It is the Member’s responsibility to update their Member Profile including their email, password, first name, surname, mobile phone, home address, date of birth, local Wild Cards & Gifts store, opt in/out to receive updates from Wild Cards & Gifts and its parent company WHSmith Australia, opt in/out Tick box to receive updates from Wild Cards & Gifts and its parent company WHSmith Australia on behalf of our business partners.

If a Member has not provided or updated Wild Cards & Gifts with correct details, Wild Cards & Gifts may not be able to contact the Member about their membership, Rewards points, special offers or entry to competitions.

At any time, Members may only have one account to the Wild Cards & Gifts Rewards Loyalty Program and one corresponding Wild Cards & Gifts Rewards Card. Members may not transfer their account or Rewards to another person.

Wild Cards & Gifts reserves the right to modify, refuse or terminate a Member’s account to the Wild Cards & Gifts Rewards Loyalty Program without notice or reason and at its absolute discretion.

Wild Cards & Gifts reserves the right to withdraw a Member’s Points Balance at any time without notice or reason and at its absolute discretion. 

A Member may end their membership at any time by contacting Wild Cards & Gifts Customer Service team by email to wildmarketing@WHSmith.com.au.

By joining the Wild Cards & Gifts Rewards Loyalty Program, an individual consent to Wild Cards & Gifts contacting them to provide them with consumer or marketing information and notifying them of Rewards or other products and special offers.

Wild Cards & Gifts Rewards CARD

Once a Member has completed the application process in store, their Wild Cards & Gifts Rewards Card will be issued directly at point of sale. Members who complete their registration/sign up on the Website must have a Wild Cards & Gifts Rewards Card prior to completing their registration/sign up.

Members may nevertheless record Points and otherwise utilise the benefits of the Wild Cards & Gifts Rewards Loyalty Program without their Wild Cards & Gifts Rewards Card for purchases in store, providing an alternative form of ID displaying the Member’s name and address.

The Wild Cards & Gifts Rewards Card remains the property of Wild Cards & Gifts at all times.

One Wild Cards & Gifts Rewards Card will be issued per Member on or after the Member’s Join Date.

A current Wild Cards & Gifts Rewards Card, or alternative form of photo ID displaying name and address must be presented by the Member for all transactions in-store including (but not limited to) requests for discounts, recording of purchases, redeeming Rewards or in response to any promotional activity specific to the Wild Cards & Gifts Rewards Loyalty Program.

Only one Wild Cards & Gifts Rewards Card can be presented for each transaction.

Members must notify Wild Cards & Gifts immediately if their Wild Cards & Gifts Rewards Card is lost, stolen or misplaced. Wild Cards & Gifts does not accept any responsibility or liability for any loss of a Member’s Wild Cards & Gifts Rewards Card or for any unauthorised redemption of Rewards.

If an individual misplaces their Wild Cards & Gifts Rewards Card they can go in store and request a new card to be issued.

If Wild Cards & Gifts invites a Member to a special event, they may be required to show their Wild Cards & Gifts Rewards Card or photo ID to gain entry or any applicable offers or discounts.

EARNING REWARDS POINTS AND VOUCHERS

The Wild Cards & Gifts Rewards Loyalty Program operates by attributing Points (as nominated by Wild Cards & Gifts from time to time) to the Wild Cards & Gifts Rewards Loyalty Program.

Members are allocated Points based on Eligible Purchases in store.

When a Member completes a transaction and identifies themselves in-store by presenting their Wild Cards & Gifts Rewards Card or photo identification, the net amount of the Valid Purchase is added to their Points Balance on the day after the transaction is made.

Where a Valid Purchase is made in store, Rewards Points will be issued based on the day the purchase is made in store and loaded onto the Member’s account approximately 24 hours after the Valid Purchase is made.

Wild Cards & Gifts will endeavour to notify the Member via email when the Member is entitled to a voucher. If a member unsubscribes from Wild Cards & Gifts Member Emails their Points Balance will be viewable online only.

At its sole discretion, Wild Cards & Gifts may update a Member account with a Voucher as a consequence of a purchasing behaviour, incentive and/or promotional activities.

Wild Cards & Gifts reserves the right to withdraw, cancel or vary the Rewards without notice and at any time for any reason whatsoever in its absolute discretion including without limitation Rewards Points and Vouchers in error or Rewards Points earned fraudulently.

Points cannot be sold, transferred or assigned and are not redeemable for cash or any other like instruments, including (but not limited to) gift Vouchers, gift cards, cheques and credit notes.

Points cannot be earned using Vouchers as part of the transaction.

If a Membership is terminated from the Wild Cards & Gifts Rewards Loyalty Program, all outstanding and future Points, Voucher or other Rewards will no longer be valid and will be rendered null and void.

When a Member returns a purchase in-store or via post, the net amount of the transaction will be deducted from the Member’s Points Balance and the Voucher that was previously awarded will be adjusted or reversed.

Members are allocated Vouchers based on their Rewards Points Balance in the following manner:

EARNING POINTS and VOUCHERS:

Wild Rewards Points may be earned on any Valid Purchase made in a Wild Cards & Gifts store, in one transaction after all discounts, exchanges, refunds and redemptions are applied.

You can redeem Rewards by visiting a Wild Cards & Gifts store and presenting your Wild Rewards Card to a Wild Cards & Gifts store staff member.

$1 dollar spent on Eligible Purchases = 1 Point.

Point Value = 0.05c

Customers will be required to complete a Wild Rewards Membership registration Sign up prior to being able to earn Points or redeem Wild Rewards Vouchers.

Every time a Member earns 100 points, they earn a $5 Voucher, e.g. Spend $100 and get a $5 Voucher. Spend $200 and get two $5 Vouchers.

The Member’s Points Balance will be deducted 100 Points at the time the $5 Voucher is created.

Any extra Points earnt over 100 are kept. For example, a Member spends $150 in one Valid Purchase and as such has 150 Points, 100 Points are deducted at the time the Voucher is created, and the 50 Points Balance accumulates towards the next Voucher.

Points can be earned on cash or eftpos transactions, and on purchasing a gift card or gift voucher.

Points cannot be earned on any purchase using a gift card, gift voucher or Voucher redemption or on credit notes.

Layby points will be earned at completion of layby.

In store promotions may apply additional points earned on the purchase of specific products, or during specific time periods. These will be communicated in store via point of sale and staff.

There is no timeframe in which the Points must be earned.

The Points Balance for a Wild Rewards Member can go down to 0 but cannot go into negative.

All Eligible Purchases will contribute to a Rewards Member’s Points Balance.

The following Rewards & Incentives are on-going:

Early access to and previews of sales and extra discounts on products not available to the public.

Invitations to in store events.

Invitations to enter Wild Rewards Member only competitions.

Additional Points Promotions:

Wild Cards & Gifts may run Wild Rewards promotions offering additional loyalty points for Wild Rewards members for a period when the promotion criteria are met.

Wild Cards & Gifts may run ‘special price’ for Wild Rewards members only.

Additional points Promotions will be communicated in store via point of sale signage and staff.

These Rewards & Incentives may be issued from time to time by Wild Cards & Gifts at its discretion and on such terms as it sees fit.

REDEMPTION OF REWARDS POINTS

Vouchers and can only be redeemed on presentation of the Wild Cards & Gifts Rewards Card or corresponding photo identification.

The currency in which Vouchers are redeemed will be in Australian Dollars (AUD).

Wild Rewards reward/vouchers currency value will be recorded as being accrued by the store where the Member Activated their Loyalty Card.

When redeeming any Voucher, the Voucher will be applied proportionally across each item purchased, based on the percentage each item represents of your total purchase. This will mean that the Reward will not be split equally across all items.

Vouchers  cannot be redeemed in conjunction with any other offer unless otherwise indicated.

Loyalty Vouchers can be redeemed at any participating Wild Cards & Gifts store.

Carindale

Doncaster

Knox City

Macarthur Square

Northlands

There is no minimum spend on redeeming Vouchers, however if a Member purchase amount is less than a Voucher amount, the remaining difference will be forfeited.  E.g. If a Member has a $9.00 purchase and chooses to use two $5 Vouchers, the change will be forfeited.

When the Member scans their Rewards Card during a transaction, the POS user will be prompted that the Member has one or more Vouchers available.  The Member can choose when they would like to redeem each individual rewards Voucher (i.e. the staff member using the in-store system will have the ability to determine whether a rewards Voucher is applied to the sale).

Multiple Vouchers can be redeemed per day (e.g. across multiple transactions).

Vouchers do not have an expiry date.

A Member can be searched for using last name, mobile number or email address, and a point balance and point/transaction history can be displayed to staff member using the in-store system.

Vouchers cannot be redeemed as payment for any part of a layby purchase.

Vouchers do not have expiry date. Wild Cards & Gifts reserves the right to impose an expiry date on Vouchers at any time on giving reasonable notice, provided that any expiry date will comply with all applicable laws.

Only Vouchers from the Wild Cards & Gifts Rewards program can be redeemed in a transaction.

Wild Cards & Gifts will not be held responsible or liable if Vouchers are not able to be redeemed for whatever reason but specifically, in the case of a Technical Issue including without limitation the failure of software or hardware or an EFTPOS malfunction.

Vouchers can only be redeemed once.

Wild Cards & Gifts reserves the right in its absolute discretion to exclude certain items and promotions from being redeemed by using Vouchers.

Returns: If a Member wishes to return a purchase for reasons other than that the goods are faulty or misdescribed:

any Vouchers redeemed or utilised during the purchase will be forfeited; and

any Vouchers that may otherwise have been obtained will be kept but the Member will have the value of the return transaction deducted from their Points Balance. This may result in the Member having a zero Points Balance.

COMPETITIONS

Wild Cards & Gifts competitions may be announced and run from time to time by Wild Cards & Gifts at its discretion and on such terms as it sees fit.

To be automatically eligible for the Wild Cards & Gifts competitions you must:

•          Be a Wild Cards & Gifts Rewards Loyalty Program Member.

•          Have opted-in for receiving updates from Wild Cards & Gifts and its parent company WHSmith Australia on behalf of our business partners.

Wild Cards & Gifts reserves the right to change or withdraw Wild Cards & Gifts competitions and the competition terms and conditions at any time.

Wild Cards & Gifts will communicate competition details via in store signage, on Instagram, Facebook and Wild Rewards Loyalty EDMS.

The respective Wild Cards & Gifts competition terms and conditions will be published on the Wild Cards & Gifts website.

Competition winners will be notified directly but details of the competition winners will not be published.

The Wild Cards & Gifts competition prize(s) recipient must be ready, willing and able to receive and/or participate in the competition as required by these terms and conditions.

Wild Cards & Gifts and its representatives will not be liable for any damage to or delay in transit of the competition prize(s) or an element of it.

Wild Cards & Gifts will take no responsibility if a competition prize(s) Recipients details are incorrect or incomplete.

Wild Cards & Gifts reserves the right to select a new competition prize(s) Recipient if a competition prize(s) Recipient cannot be contacted within 24 hours or if the competition prize(s) cannot be received by competition prize(s) Recipient.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees or implied warranties as provided under any applicable consumer protection laws.

Except for any liability which cannot be excluded by law, Wild Cards & Gifts and its associated companies are not responsible for and exclude all liability (including negligence) for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the competition.
